The Constitution of the State of New York

ARTICLE XVII
SOCIAL WELFARE

[Public relief and care)
Section 1. The aid, care and support of the needy are public concerns and shall be provided by the state and by such of its subdivisions , and in such manner and by such means, as the legislature may
from time to time determine . (New. Adopted by Constitutional Convention of 1938 and approved by vote of the people November 8, 1938.}

Governor Andrew Cuomo and Mayor Bill de Stasio have put forth public policy agendas that have been labeled “progressive” in areas such as:minimum wage; paid family leave:and affordable housing.Conservatives point to tax and regulation policies that they say stunts economic and job growth.

Question:

Is Article XVII outdated and should government be responsible for reducing poverty?

You will have to explore the history and meaning of Article XVII and why it speaks to “New York values.” What is the government “safety net?” should the rote of government go beyond education and partnership with the nonprofit and private sectors (including tax policy and subsidies) in an effort to prevent or reduce poverty? Is compassion a failed social and economic policy? What are the unintended consequences of raising the minimum wage and imposing certain labor benefits on the private and nonprofit sectors? How should we measure outcomes? Is the current national mood a reflection of the public’s anger with policies that are not working or a dysfunctional government where politics continues to have a significant impact (adverse or otherwise)?
